The Role of Freedom of Speech in Modern Digital Media in India

Abstract

The digital transformation in India has created a complex intersection between constitutional guarantees of free speech under Article 19(1)(a) and the rapidly evolving landscape of digital platforms, generating tensions among individual expression, state regulation, and platform governance. The synthesized literature reveals a contested landscape where legal scholarship predominantly frames digital speech through constitutional doctrines of reasonable restrictions, while social science research emphasizes the lived experiences of users facing disproportionate censorship. A significant body of work documents how regulatory interventions-including the Information Technology Rules of 2021-frequently generate overbroad blocking orders, chilling effects, and opaque content moderation practices that paradoxically undermine democratic processes. The evidence consistently demonstrates that algorithmic governance and platform policies can inadvertently reproduce structural inequalities. We conclude that freedom of speech in Indian digital media is a dynamic terrain shaped by the interplay of legal frameworks, platform architectures, state power, and user agency, and we identify substantial gaps in empirical research on user perceptions, self-regulatory mechanisms, and long-term democratic implications that require interdisciplinary investigation.
